Probate, Trust and Estate Planning

Several of the firm's lawyers practice in the area of Trusts and Estates Law. One is a fellow of the American College of Trust and Estate Counsel. Another is a Certified Specialist in Estate Planning, Trust and Probate Law under the Board of Legal Specialization of the State Bar of California. Estate and trust administration involves the representation of fiduciaries, sometimes court-appointed (estates and some trusts), sometimes not (most trusts). The firm's lawyers assist the fiduciary (executor, administrator, trustee) in handling all of his or her duties, including court filings, management and sale of property, and tax compliance. In addition to administration of trusts following the death of a settlor, the firm's lawyers provide advice regarding alternative means for dealing with transfers of assets at death. Domestic and international estate planning is the second component of the Trusts and Estates practice at Overton, Lyman & Prince. From standard estate plans to ones involving millions of dollars and the full variety of sophisticated techniques, the firm's lawyers focus on the client's needs and wishes to craft a plan that accomplishes the settlement of the client's personal and financial affairs with the greatest savings in complexity, time and taxes. Unique in this area of practice is the firm's expertise regarding property owned and business transacted in Mexico. Since the acquisition and development of real property in Mexico has substantially increased recently, the need for general counsel on acquisition and estate planning in this respect is increasing. The firm has a long standing relationship with lawyers in Mexico who facilitate providing this expertise for the firm's clients.
